The provisions and clauses below and attached to this solicitation have been determined by the Contracting Officer to be necessary
for this acquisition and consistent with customary commercial practices. All provisions and clauses incorporated by reference are
available at https://www.acquisition.gov/far-overhaul.
Addendum to RFO 52.212-4(d), Changes:
Changes in the terms and conditions of this contract may be made only by written agreement of the parties, except for the following
actions:
1. Exercising of Options pursuant to RFO 52.217-8 and RFO 52.217-9, and incorporation of wage
determinations in accordance with the Service Contract Act or the Davis Bacon Act.
2. Administrative changes such as the paying office, accounting classifications, in accordance with RFO 43.203(b).
3. Modifications to obligate or de-obligate funds for not to exceed CLINS.
4. Modifications to obligate funds at the beginning of each fiscal year and incremental funding.
The following DAF Contracting Compass provisions/clauses are included, and will apply to the subsequent contract:
DAF CC Part 1, Ombudsman (AETC)** Applicable to all solicitations
(a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When
requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the
program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection
process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the interested party to another official who can resolve the concern.
(b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting
officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests,
requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions).
(c) If resolution cannot be made by the contracting officer, the interested party may contact the ombudsman, Mr. Juan Martinez, Deputy Director, AFICC/KT, 2035
