2. Nature and/or Description of the Action Being Approved:
This procurement is for the AutonoMe Hospital Environmental Control Unit (ECU)
systems within VAPAHCS in accordance with FAR 12.102 Restricting Competition
for the Acquisition of Commercial Products and Commercial Services, where
acquisitions conducted are exempt from the requirements of FAR Part 6, but still
requires a justification using the format of FAR 6.104-1.
The action will not be competed and will be procured as a sole source. The contract
will be a firm fixed price Open Market contract. This is a new requirement.
3. Description of Supplies/Services Required to Meet the Agency’s Needs:
VAPAHCS requires an upgrade of the existing AutonoME Hospital ECU systems
within the Spinal Cord Injury (SCI) Center. The scope of work includes replacing
outdated AutonoMe components, installing upgraded AutonoMe Hospital systems,
performing necessary device integrations, conducting functional testing, and
providing training for designated staff groups.

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the
Acquisition Requires the Use of the Authority Cited Above (applicability of
authority):
AutonoMe is the only responsible source capable of meeting the VAPAHCS
requirements for upgrading existing ECU systems in the SCI Center. The current
veteran rooms are fully outfitted with AutonoMe hardware, software, integration
cabling, and room-specific mounting infrastructure. The AutonoMe systems are a
proprietary platform, and only the original manufacturer Accessibility Services Inc
can provide compatible replacement components, firmware, software updates,
device-level integrations, and the required functional interoperability with the existing
system architecture.
Accessibility Services Inc is also the only source with proprietary technical data,
configuration control, and integration rights necessary to install, calibrate, and verify
the systems to VA clinical/biomedical standards. No other vendor can maintain,
modify, or replace AutonoMe components without violating proprietary restrictions or
compromising system functionality or veteran safety. To consider another
manufacturer would create substantial duplication of cost to the government that is
not expected to be recovered through competition.

6. Description of Efforts Made to ensure that offers are solicited from as many
potential sources as possible (including whether a notice was or will be
publicized as required by RFO Part 5 and, if not, which exception under RFO
Part 5 applies):
Market research was conducted, and no other distributors of the AutonoMe could be
found. The equipment and software requested are proprietary to the Original
Equipment Manufacturer (OEM) Accessibility Services Inc, it is not possible to
procure the items needed from alternative sources.
7. Determination by the CO that the Anticipated Cost to the Government will be
Fair and Reasonable:
Fair and reasonable pricing will be compared to the Independent Government Cost
Estimate, and Past procurement history.
8. Description of the Market Research Conducted and the Results, or a
Statement of the Reasons Market Research Was Not Conducted
