STATEMENT OF WORK (Medical Malpractice Data) 5/27/2026 I. SCOPE Data is needed to update and expand the medical professional liability indexes that CMS produces for use in the CMS market baskets. A. Background The AM BEST State Rate Filing Database allows users to compare companies and monitor property/casualty filing information. AM Best's State Rate Filings gives you access to policy rate, rule and form changes, loss cost information and new programs for thousands of P/C insurers -- with complete filings included at no additional cost. This data is currently only available through the State Insurance Commissioners and we would have to go to every state in person and manually pull the data from files in order to collect this information. The AM Best's State Rate Filings provide convenient online access to rate filings, now in one comprehensive archive. The redesigned site features enhanced search options and streamlined search results for complete filings and notable filings with descriptive summaries. B. Purpose For purposes of developing the physician and hospital professional liability insurance premium indexes for the Medicare Market Baskets used by CMS to annually update provider Medicare payments. The National Health Statistics Group (NHSG) in the Office of the Actuary (OACT) would like to purchase access to the state rate filings data from AM Best which would provide access to any approved rate increases over time for every company providing medical malpractice insurance, for all 50 states and Washington D.C. We will use this data to expand the coverage and investigate the possibility of revising the methodology for constructing a hospital malpractice index and the possibility of creating other types of medical malpractice indexes, such as for nursing care facilities, and allied health professionals. II. REQUIREMENTS Independently and not as an agent of the Government, the Contractor shall furnish all the necessary services and data as needed to perform the requirements of this Statement of Work. A. Requirements/Tasks to be Performed. Provide 12-month access to an online database of state rate filings. This database allows the following: 1. Review complete filings for all 50 states and DC, dating back to 2008. 2. Descriptive filing summaries which isolate the key pieces of information. 3. View exclusive market share and rank information based on lines of business -- 1 of 3 -- available only from A.M. Best. 4. Export results to Microsoft Excel or PDF formats. 5. Create or save customized alerts for e-mail notification of filing changes for selected states, major lines, filing actions and/or companies. B. Report Requirements This section is not a list of deliverables. Report requirements may include financial, management, progress, draft and final reports, as well as any other data requirements. This section will include the format and content of each report, number of copies, expected length, and place and method of delivery. The Contractor shall provide access to the online database for unlimited users to the AM BEST State Rate Filings database for all available states (currently 50), beginning on July 28, 2026. The data shall be available for 12 months from the original date of access and include all years of data available. C. Period of Performance The period of performance for completion of all requirements under this contract is July 28, 2026, through July 27, 2027. III. QUALITY ASSURANCE The COR and technical lead will review data described in section II.B. of this SOW and provide comment(s) to the Contractor within 30 days of receipt. IV. SECTION 508 COMPLIANCE: The deliverables shall comply with the standards, policies, and procedures below. In the event of conflicts between the referenced documents and this SOW, the SOW shall take precedence.
