Technical data that are export-controlled must be marked with an export control warning notice. (a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:
Comparative Analysis: Technical and Price
Limitation on Evaluation and Comparative Analysis:The Government will conduct an initial review of all submitted quotations to verify they conform to the basic combined synopsis/solicitation requirements. Following this initial review, the Government will rank the conforming quotations by price (from lowest to highest). The Government will then limit its detailed comparative analysis and final consideration for award to only the top five (5) lowest-priced quotations. The Government will compare the technical features and prices of these top five (5) quotations against one another to determine which offer is the most advantageous and provides the best value to the Government. Quotations not in the top five (5) lowest-priced tier will not be further evaluated.
(b) Options (if applicable). The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).
(c) Notice of award. A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
