JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN
COMPETITION
1. Contracting Activity.
The contracting activity is Naval Facilities Engineering Systems Command, Mid-Atlantic
(NAVFAC MIDLANT).
2. Description of the Action Being Approved.
This Justification and Approval (J&A) authorizes the use of brand name specifications for
three (3) ID factors 2-factor card readers, one (1) Lenel power supply enclosure, one (1)
access control reader, one (1) intrusion detection control, one (1) request to exit device, one
(1) Securitron PB5 exit device, one (1) HES electric strikes, one (1) HES-9600 electric
strike, one (1) gate lock and one (1) balanced magnetic switch required for the electronic
security system (ESS). The products will be used in N4008526R0107 Repairs and
Upgrades to Acoustic and Machinery Lab, Building 87, Naval Surface Warfare Center,
Philadelphia Division, Phildadelphia, PA.
3. Description of Supplies/Services.
The intent of solicitation N4008526R0107 includes repairs and upgrades to the Acoustic and
Machinery Lab in Building 87 and incidental related work. The building is located at the
Philadelphia Navy Yard for the Naval Surface Warfare Center Philadelphia Division
(NSWCPD) in Philadelphia, Pennsylvania. Building 87 is utilized by NSWC as a research,
development, testing and evaluation facility.
The proposed action will optimize the layout of the existing Subsurface Acoustic and
Machinery Laboratory in Building 87 at PNYA. The proposed action includes test facility
upgrades, layout optimization to maximize testing operations, removal of unused
equipment, installation of new equipment (including a dryer, compressed air tank, sound
acoustical enclosure, replacement of a high pressure air line, upscaled piping sizes, and third
air storage bottle), additional facility storage, additional utility hookups, combining two
existing control rooms, and miscellaneous repairs/replacements.

4. Statutory Authority Permitting Other Than Full and Open Competition.
The statutory authority for this acquisition permitting other than full and open competition is 10
U.S.C. 3204(a)(1) which permits the use of limited suppliers when it is essential to the
Government’s requirements, as implemented by Federal Acquisition Regulation (FAR) 6.103-1
(DEVIATION 2026-O0017), Only one responsible source and no other supplies or services will
satisfy agency requirements
5. Rationale Justifying Use of Cited Statutory Authority.
This Justification and Approval seeks to require inclusion of brand names in the above-
referenced solicitation for the ESS. The hardware/software listed above supports the existing
Access Control, Intrusion Detection, and Camera systems. The parts listed above are required
because they are the only brand that is compatible with the existing systems. The use of other
brand material would not work correctly in the existing security systems; therefore, the above
brand name items are required.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
A Sources Sought announcement was posted on the SAM.gov website on 10 July 2026 seeking
qualified vendors for the above specified work with brand name materials. The Sources Sought
announcement closed on 17 July 2026, there were seven (7) interested parties with responses to the
Sources Sought notice. All seven parties replied to the sources sought with interest to submit
proposal documentation. Parties provided their companies information, qualifications, and
explanations of completing similar projects related to the requirements outlined in the sources sought
with experience of work sought with letters of interest and capability statements. No responses were
received offering equal or compatible projects for the specified brand name items that were being
considered. The approved J&A will also be made publicly available as required by FAR 6.301
(DEVIATION 2026-O0017).
7. Determination of Fair and Reasonable Cost.
8. Actions to Remove Barriers to Future Competition.
For the reasons set forth in Paragraph 5, NAVFAC Mid-Atlantic has no plans at this time to
compete future contracts for the types of supplies/services covered by this document. If another
potential source emerges, NAVFAC Mid- Atlantic will assess whether competition for future
requirements is feasible.
