Answer-1: Instructors sourced through an established language training institute under a subcontracting agreement may be considered acceptable only if all of the following conditions are fully satisfied. Failure to meet any of these requirements may result in disqualification of the proposed staffing approach. 1. Strict Qualification Compliance: Every subcontracted instructor must fully meet — without exception — all qualification, certification, education, and experience requirements specified in the Statement of Work (SOW)/Performance Work Statement (PWS). The prime contractor must submit documented evidence (e.g., certifications, transcripts etc) for each proposed instructor at the time of proposal submission. Proposals that fail to provide this documentation upfront may be deemed non-responsive. 2. Full Disclosure of Subcontracting Arrangement: The prime contractor must explicitly identify, in writing, the name and credentials of the language training institute, the exact scope of work being subcontracted, and a clear justification for why subcontracted instructors are necessary. Any lack of transparency in the proposal regarding subcontracting arrangements will be treated as a material deficiency. 3. Accountability: The prime contractor bears full and sole responsibility for subcontractor performance. The prime contractor must implement and describe, in its proposal, a clear oversight and quality control mechanism to monitor subcontracted instructor performance throughout the period of performance. The U.S. Government reserves the right to reject any subcontracted instructor who fails to meet performance standards, at any time during contract performance, without penalty to the Government. 4.
