Notice of Intent to Award a Sole Source Contract.
Pursuant to FAR 6.103-1 and inclusive of the Revolutionary FAR Overhaul (RFO) – FAR Part Deviation Guidance, The Federal Railroad Administration (FRA) hereby submits a notice of intent to negotiate a single-source firm fixed price (FFP) purchase order with Berkeley Simulation Software (BSS) for the purchase of a Rail Traffic Controller (RTC) license and maintenance plans. The value of this contract is anticipated to be approximately $43,878.
The NAICS code for this procurement is 513210 – Software Publishers. This single-source requirement meets the conditions of FAR 6.103-1(b), in that only one responsible source has been identified as reasonably available to provide the supplies that will satisfy the agency’s requirements.
RTC is a rail operations software program that simulates the movement of trains through rail networks at a detailed and realistic level. RTC is specifically utilized by FRA grantees for project development. The purchase of an RTC software license and maintenance plans is essential to allow the FRA to review simulations developed for grant purposes.
This notice is NOT a request for proposals or quotations, and any information received as a result of this notice will be considered solely for the purpose of determining whether a competitive procurement should be conducted. However, interested parties may submit a description of their firm’s capabilities to satisfy this requirement, demonstrating their ability to successfully perform this effort.
The determination not to compete this proposed contract action is solely within the discretion of the Government. If parties choose to respond, any cost associated with preparation and submission of data or any other cost incurred in response to this announcement are the sole responsibility of the respondent and will not be reimbursed by the Government. No solicitation will be issued, and no telephone inquiries will be accepted. No contract award will be made on the basis of proposals or quotations received in response to this notice.
