Statement of Work (SOW) 1. Background The United States Merchant Marine Academy (USMMA), Kings Point, NY, is conducting environmental cleaning of its indoor firearms training range. An independent monitoring and sampling contractor is required to oversee activities involving lead contamination and verify regulatory compliance. USMMA is listed on the National Register of Historic Places on August 29, 2014. Therefore, all work shall be consistent with the Secretary of the Interior's Standards for the Treatment of Historic Properties (36 CFR part 68). http://www.nps.gov/tps/standards/four- treatments/treatment-guidelines.pdf. Additionally, all work shall meet or exceed the standards provided in the Secretary of the Interior’s Standards for Rehabilitation and guidelines for applying the standards published by the National Park Service, U.S. Department of the Interior 36 CFR 67.7 - Standards for rehabilitation.” 2. Purpose The purpose of this contract is to provide independent third-party environmental monitoring, sampling, and oversight services during the Bowditch Hall indoor gun range environmental deep cleaning project. Services shall comply with all applicable federal and New York State regulations, including OSHA lead standards, EPA lead and hazardous waste requirements, HUD/EPA lead-safe work practices, New York State Department of Labor regulations, and New York State Department of Environmental Conservation requirements. 3. Scope of Work The Contractor shall furnish all labor, equipment, certifications, sampling media, and reporting required to independently monitor and verify the indoor range cleaning operations. 3.1 Pre-Work Activities Review contractor plans, attend coordination meetings, and submit a Site-Specific Monitoring and Sampling Plan. 3.2 On-Site Monitoring Provide air monitoring, surface wipe sampling, and observe work practices to ensure compliance with approved procedures. 3.3 HEPA Filter Replacement Oversight Observe removal, disposal, and installation of HEPA filters and verify safe handling and installation practices. 3.4 Lead-Based Paint Encapsulation Oversight Verify encapsulation work is conducted properly and without prohibited abrasive methods. -- 1 of 2 -- 3.5 Brass Recycling Verification Observe casing recovery and review recycling documentation. 3.6 Post-Cleaning Clearance Conduct clearance sampling and provide written clearance recommendations. 4. Deliverables Monitoring Plan, Daily Logs, Sampling Results, Non-Compliance Notices, and Final Report. 5. Labor Standards This project is subject to the Davis-Bacon Act using Nassau County, NY wage determinations. 6. Period of Performance • Concurrent with cleaning contractor activities, not to exceed 30 calendar days from Notice to Proceed (NTP). • On-site work is anticipated to last approximately 3-5 working days. 7. Acceptance Criteria Services accepted upon completion of approved monitoring, sampling, and reporting. 8. Notes and Assumptions • All work must be completed between normal business hours of operation (7am – 4:00pm), Monday – Friday, unless additional approval is granted by the CO and COR. • Contractor site visit walkthrough prior to project bid. • Awarded contractor shall work with the academy’s awarded remediation contractor. • Awarded contractor shall provide microbiology, toxicology and chemistry laboratory services. Contractor must submit documentation showing that the laboratory is currently accredited by NYS, under the Environmental Laboratory Approval Program (ELAP), prior to the award date. • Recleaning shall be conducted if current regulatory clearance levels are not met. • Re-application and/or additional application of encapsulant shall be performed if current regulatory clearance levels are not met. • Recleaning and/or additional application of encapsulant shall be performed repeatedly until clearance levels are met at no additional cost incurred to USMMA and the government. • Resampling shall be conducted if current regulatory clearance levels are not met at no additional cost incurred to USMMA and the government. • Awarded contractor is responsible for any subcontractors that may be used throughout this project.
