1. GENERAL INFORMATION & SCOPE
1.1. PROGRAM OVERVIEW
1.1.1. Support: This Performance Work Statement (PWS) supports the Utah Test and
Training Range, Detachment 1 (UTTR/DET1) located on Dugway Proving Ground
(DPG). DPG is a strictly controlled military installation and a restricted access area.
1.1.2. Scope of Services: The Government requires non-personal services for the rental,
delivery, relocation, cleaning, servicing, and maintenance of portable toilet units and
portable toilet trailer units.
1.1.3. Contractor Responsibilities: The Contractor shall provide the items and services
necessary for complete performance of this PWS. The Contractor shall provide personnel,
equipment, tools, supplies, parts, vehicles, supervision, transportation and services
necessary to furnish, deliver, set up, relocate, clean, perform weekly service, maintain, and
remove units as specified in this PWS.
1.1.4. Regulatory Compliance: The Contractor shall perform the services in accordance
with the requirements of this PWS, commercial industry standards, and applicable
Federal, State, and local regulations.
1.1.5. Contract Pricing and Costs: This is a Firm-Fixed-Price requirement. The Contractor
shall be paid the fixed unit or total price(s) established in the contract. The contract price
is not subject to adjustments based on the Contractor’s cost experience or performance in
executing the requirements of this PWS. (FAR 16.202-1)
1.1.6. Definition of Units: For the purposes of this solicitation, the resulting contract, and
this PWS, the term “unit(s)” refers to Contractor-supplied portable toilets and portable
toilet trailers.
1.2. SUBCONTRACTING
1.2.1. Definitions: The term “Contractor” refers exclusively to the Prime Contractor. The
term Subcontractor “means any supplier, distributor, vendor, or firm that furnishes
supplies or services to or for a prime contractor or another subcontractor. (Federal
Acquisition Regulation (FAR) 44.101)
1.2.2. Responsibility: Subcontractors shall meet the same requirements and regulations
outlined in this PWS. The Contractor shall remain solely responsible for its
subcontractors performing work under this PWS.
1.2.3. No Privity of Contract: Privity of contract does not exist between the Government
and subcontractors. The Government provides direction and payment exclusively to the
Prime Contractor and holds no responsibility for managing or resolving disputes between
the Prime Contractor and its subcontractor(s).

1.3. NON-PERSONAL SERVICES
1.3.1. Task Management: The Government will not supervise or control the method by
which the Contractor performs the required tasks, nor will it assign tasks to or prepare
work schedules for Contractor personnel.
1.3.2. Personnel Management: The Contractor shall strictly manage its personnel to guard
against actions that constitute, or are perceived to constitute, personal services. Personnel
shall be supervised by, and report solely to, their own management.
1.4. GOVERNMENT ROLES AND RESPONSIBILITIES
1.4.1. Contracting Officer (CO): The CO is the only individual authorized to modify the
scope, scale, price, terms, or conditions of the contract. The Contractor shall not take
direction from Government personnel that alters the contract without an official written
modification from the CO.
1.4.2. Contracting Officer’s Representative (COR)
1.4.2.1. Designation and Authority: The COR will be identified by separate letter
NLT 10 business days prior to Period of Performance (PoP) start. The COR does
not have the authority to provide direction outside the scope of the contract. The
CO retains the sole right to issue modifications and change orders.
